ARNOLD PALMER BY STITCH SWEEPSTAKES
NO PURCHASE NECESSARY: THERE IS NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.
ELIGIBILITY: The ARNOLD PALMER BY STITCH SWEEPSTAKES (the “Sweepstakes”) is open only to legal residents of the United States who are at least eighteen (18) years old at the time of entry. Void where prohibited. Employees of STITCH Golf Holdings, LLC. (“Sponsor”) and its parent(s), affiliate(s), subsidiary companies, and suppliers, as well as the immediate family (spouse, parents, siblings and children and their respective spouses, regardless of where they reside) and household members of each such employee, whether or not related, are also not eligible. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Participation constitutes the entrant’s full and unconditional agreement to these Official Rules and the Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning the prize is contingent upon fulfilling all requirements set forth herein.

TIMING: The Sweepstakes begins on Monday, September 10, 2018 at 8am Eastern Standard Time ("EST") and ends on Monday, September 24, 2018 at 8pm Eastern Standard Time ("EST") (the "Promotion Period"). The Sponsor’s computer is the official time keeping device for this Sweepstakes.
All entrants must have an internet connected device, a valid and working email address, a web browser, or have access to mail their entry to enter the Sweepstakes. How to Enter: There are (2) ways to enter the Sweepstakes:
(1) Enter via stitchgolf.com/pages/stitchgolfsweepstakes using the “Sweepstakes” link and entering the required information during the Promotion Period. (2) During the Promotion Period, write your full name, address, telephone number, email address and date of birth on a 3"x5" card and mail it in a stamped envelope to 158 Towerview Court Cary, NC 27513. Entries must be postmarked by September 22, 2018. Late entries will not be acknowledged or returned. Proof of sending will not be deemed as proof of receipt.
The information you provide will only be used for the Sponsor and other ARNOLD PALMER BY STITCH SWEEPSTAKES (the “Sweepstakes”) affiliate(s). Sponsor reserves the right in its sole discretion to disqualify an entry at any time in which the Sponsor’s opinion does not comply with these Official Rules.
LIMIT: Each participant may enter one (1) time during the Promotion Period. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using the same or multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate or subvert the entry process is prohibited and will result in disqualification. Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, delayed, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant and he/she must comply with these Official Rules. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
SWEEPSTAKES DRAWING: The Sponsor’s decisions as to the administration and operation of the Sweepstakes and the selection of the potential winners are final and binding in all matters related to the Sweepstakes . Sponsor will select the potential Sweepstakes winners by a random drawing from all eligible entries received during the Promotion Period, on or around September 24, 2018. The potential winners will be notified by email. The potential winners will be required to sign and return an Affidavit of Eligibility, Liability & Publicity Release ("Affidavit"), which must be received by Sponsor within three (3) days of the date notice or attempted notice is sent, in order to claim the prize. If the potential winners cannot be contacted, or fail to sign and return the Affidavit within the required time period, potential winners will be disqualified. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that the potential winners are disqualified for any reason, he/she will forfeit the prize and Sponsor will award the prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded.

(1) Round for (4) players at Bay Hill Club & Lodge (Approximate retail value $1,400) OR Latrobe Country Club if Bay Hill Club & Lodge is inconvenient.
Travel and accommodations will not be included.
Round of golf for (4) four is subject to availability at Bay Hill Club & Lodge and Latrobe Country Club. The winner will be given a certificate that will be valid for one year, blackout dates may apply, original certificate MUST be presented at the time of redemption and should call the Bay Hill Reservation line to make arrangements. After a winner is named, Bay Hill Club & Lodge will generate a certificate.
Odds of winning the prizes depend on the number of eligible entries received during the Promotion Period. No cash equivalent and prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of comparable or greater value, at its sole discretion. Winner is responsible for all taxes and fees associated with prize receipt and/or use not specified herein as being provided. Use of winnings may be subject to additional terms and conditions.
GENERAL RELEASE: By participating, entrant agrees to release and hold harmless Facebook, Sponsor and its respective parent(s), subsidiaries, affiliates, suppliers, distributors, and each of their respective officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of the prize.
PUBLICITY: Participation in the Sweepstakes constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions, and/or hometown and state for advertising, promotional and all other purposes in any and all media, now or hereafter known, worldwide in perpetuity, without further payment or consideration, notification or permission.
GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prize at random from among all non-suspect eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the website or Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner and void all associated entries. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, typographical, printing or other errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in the administration of the Sweepstakes, the processing of entries, the announcement of the prize or in any Sweepstakes-related materials; and/or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of the prize. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss of data, income or profit; loss of damage to property; and claims of third parties. ENTRANTS AGREE THAT THE RELEASED PARTIES HAVE NOT MADE NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, OR NON INFRINGEMENT), IN FACT OR IN LAW, AS REGARDS TO THE PRIZES OR ANY COMPONENTS OF THE PRIZES IN THE SWEEPSTAKES.
INDEMNIFICATION AND HOLD HARMLESS AGREEMENT: Sponsor and its parent(s) and subsidiaries are not responsible for, and shall be defended, indemnified, held harmless and released by each Prize Winner against any claims, liabilities, lawsuits, judgments, causes of action, proceedings, injuries, death, losses, costs, expenses or damages of any kind resulting from, in connection with, or arising from acceptance, receipt, delivery, use, nonuse, misuse, defect in, inability to use, possession, or loss of prize. Furthermore, each Entrant, as a condition of participating in the Sweepstakes, agrees to release, defend, indemnify and hold harmless Sponsor, its parent(s) and subsidiaries, from and against any injuries, death, losses, costs, expenses, damages, claims, judgments, causes of action and any liability of any kind in connection with, resulting from or arising from these Sweepstakes, participation in the Sweepstakes, including without limitation, acceptance, receipt, delivery, possession, use, misuse, inability to use, defect or nonuse or loss of the prize that may be awarded. Sponsor and its parent(s) and subsidiaries shall not be liable to any Prize Winner or any other person for any part thereof, by reason of any acts of God; any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entities (whether or not they prove to be valid); equipment failure; terrorist acts; earthquake; fire; flood; war; explosion; unusually severe weather; hurricane; embargo; labor dispute or strike (whether legal or illegal); labor or material shortage; transportation interruption of any kind; work slow-down; civil disturbance; insurrection; riot; or any other cause beyond Sponsor's sole control. By playing the Sweepstakes each Entrant agrees: (i) to be bound by these Official Rules and by all applicable laws and decisions of Sponsor which shall be binding and final; (ii) to waive any rights to claim ambiguity with respect to these Official Rules; (iii) to waive all of his/her rights to bring any claim, action, or proceeding against Sponsor, its parent(s) or subsidiaries, in connection with the Sweepstakes and (iv) to forever and irrevocably release, defend, indemnify, and hold harmless each of the Released Parties from any liability (including, but not limited to, liability for defamation, libel, slander, invasion of privacy, infringement of publicity or any intellectual property rights, any property loss, damage, personal injury, bodily injury, death, expense, accident, delay, inconvenience or irregularity, and any indirect, incidental, consequential, special, punitive or exemplary damages of any kind even if the Released Parties have been advised of the possibility of such loss or damages), costs and expenses (including, without limitation, reasonable outside attorneys' fees) that may arise in connection with: (a) the Sweepstakes, including but not limited to any Sweepstakes -related activity or element thereof, and the Entrant's entry, participation or inability to participate in these Sweepstakes (b) the violation of any third party privacy, personal, publicity or proprietary rights, (c) typographical errors in these Official Rules or any Sweepstakes materials, (d) acceptance, attendance at, receipt, participation in, delivery of, possession, defects in, use, non-use, misuse or inability to use a prize (or any component thereof), (e) any change in the prizing (or any components thereof) due to unavailability, business or creative considerations, or due to reasons beyond Sponsor's control, including but not limited to by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not such action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, threatened or actual terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond any of the Sponsor and Others' control, or as otherwise permitted in these Official Rules, (f) any interruptions in or postponement, cancellation, or modification of these Sweepstakes, (g) human error, (h) incorrect or inaccurate transcription, receipt or transmission of any part of the entry (including, without limitation, the information or any parts thereof), (i) any technical malfunctions or unavailability of the website promotion or any telephone network, computer system, computer online system, computer timing and/or dating mechanism, computer equipment, software, or Internet service provider, or mail service utilized by any of the Sponsor and Others or by an Entrant, (j) interruption or inability to access the Sweepstakes, Facebook.com or any other Sweepstakes -related web pages, or any online service via the Internet due to hardware or software compatibility problems, (k) any damage to Entrant's (or any third person's) computer and/or its contents related to or resulting from any part of these Sweepstakes (l) any lost/delayed data transmissions, omissions, interruptions, defects, and/or any other errors or malfunctions, (m) any late, lost, stolen, mutilated, misdirected, illegible, delayed, garbled, corrupted, destroyed, incomplete, undeliverable or damaged entries, (n) any wrongful, negligent, or unauthorized act or omission on the part of any of the Sponsor, parent(s) or subsidiaries, or any of their agents or employees, (o) cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the shipping companies delivering the prizes, or any other persons providing any of these delivery services , (p) lost, late, stolen, damaged, delayed, or misdirected prizes (or any element thereof), (q) the collection, use and/or sharing of Entrant's personally identifiable information by Sponsor or its designees or (r) the negligence or willful misconduct by Entrant.
REENTRY AND REDRAW: If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for the prize offered herein.
DISPUTES: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded that are not resolved by mutual agreement shall be settled by arbitration in accordance with the then-existing American Arbitration Rules promulgated by the American Arbitration Association (AAA); (2) the arbitration shall be held in Raleigh, North Carolina and shall apply the substantive law of North Carolina; (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, and in no event will entrant be permitted to obtain attorneys’ fees or other legal costs; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of North Carolina, without giving effect to any choice of law or conflict of law rules (whether of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than North Carolina.
WINNER'S NAME: Winner's Name requests will only be accepted after Monday, September 24, 2018 at 8pm Eastern Standard Time ("EST") and no later than Monday, October 1, 2018 at 8pm Eastern Standard Time ("EST").
